These Terms of Service (“Terms”) govern your access to and use of the Operun browser extension and cloud service (the “Service”), operated by Operun (“we”, “our”, “us”). By accessing or using the Service you agree to be bound by these Terms.
1. The Service
Operun is a browser automation kernel that lets a cloud “brain” drive “edge hands” — the extension running in your browser — to automate repetitive web operations such as navigation, clicking, typing and capture. The Service is provided on a metered, credit-based subscription model.
2. Eligibility and accounts
You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and runner tokens, and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use.
3. Acceptable use
You agree not to:
- Use the Service to violate any law, regulation or third-party right;
- Access or automate websites in violation of their terms of service;
- Attempt to interfere with, disrupt, or reverse-engineer the Service;
- Use the Service to transmit malware, spam or other harmful content;
- Resell, sublicense or otherwise redistribute the Service except as expressly permitted.
4. Credits and billing
The Service is billed on a credit basis. Each automated step consumes credits according to the pricing plan you select. Credits are settled atomically through an in-flight escrow as tasks complete. Fees are non-refundable except where required by law. You are responsible for any taxes applicable to your purchase. We may change pricing with reasonable advance notice.
5. Intellectual property
The Service, including its software, branding and documentation, is owned by Operun and its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You retain all rights to your own data.
6. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we handle your information. Operun is local-first: credentials, cookies and session tokens are processed in memory on your device and never uploaded to the cloud.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPERUN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify and hold harmless Operun, its affiliates, officers and employees from any claim or demand arising out of your use of the Service in violation of these Terms or of applicable law.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, or for operational reasons, with reasonable notice where practicable.
11. Changes to these Terms
We may modify these Terms from time to time. Material changes will take effect after we post the updated Terms with a new effective date. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which Operun operates, without regard to conflict-of-law principles. Any dispute shall be resolved in the courts of that jurisdiction.
